TERMS AND CONDITIONS

The following are the terms and conditions under which VisaPoint accepts instructions from clients. These terms and conditions govern the provision of services by VisaPoint relating to the processing of visas, passports and/or other documents for their clients.

When submitting an application to VisaPoint, the client accepts all restrictions and limits on liability covered by this document. Specifically, VisaPoint will not be liable for the client’s failure to meet visa requirements, the action or lack of action by any government organization or the errors of any external delivery company. VisaPoint will not be liable for any indirect losses or damages, including lost profits or exemplary damages.  In the event of the client failing to obtain a visa or visas within the necessary time period, the maximum liability of VisaPoint will be the return of the lower of VisaPoint handling fee paid by the client or £200, and VisaPoint’s total liability will never exceed this figure. All claims against VisaPoint must be filed not later than 45 days after the invoice date.           

VisaPoint will not be liable for the actions of any consulate, embassy or passport office that result in the delay or failure in the issuing of visas. VisaPoint will not be liable for expenses or delays deriving from:

  • Missing information on application forms
  • Mistakes or false information on application forms
  • Erroneous or incomplete supporting documentation

VisaPoint will not be liable for delays or expenses caused by the above and will not be liable for any related costs. Clients should not purchase travel tickets before the relevant visas or passports have been issued, except in the case that this is a specific requirement of a particular consulate. In such a case, clients are advised to purchase open tickets.

In the case of a request for an Australian ETA OR USA ESTA, the fee payable to VisaPoint includes processing the ETA/ESTA visa only and does not cover appeals or other services. The fee for the ETA/ESTA application is non-refundable – if your application is refused, or a previous ETA/US ESTA is found, the client will not be entitled to a refund. In this case VisaPoint will issue confirmation of the client’s current ETA status. In the case of any client error on the ETA/ESTA application, VisaPoint offers a correction service for a fee of £20.

If an ETA/ESTA is referred, VisaPoint will provide assistance to the client, on payment of a fee, to obtain documents that meet the client’s travel requirements. As always, travel tickets should not be purchased until all necessary documents have been obtained.

VisaPoint provides visa and passport information based on information obtained from the various embassies, consulate and passport offices. VisaPoint will not be liable in any way for errors and/or omissions in this information.

VisaPoint will follow the client’s instructions in the processing of visas, passports and other documents. It is, however, the responsibility of the client to check the validity of the visa/passport/document obtained. The client is also responsible for ensuring that this validity matches the period of time that the client intends to stay in the country or countries to be visited, that the number of entries is correct and that the document is valid for the purpose intended.

Should a passport, document or other item be lost, misplaced, damaged, delayed or destroyed, VisaPoint will only be responsible for the replacement cost of the item if the fault lies with VisaPoint. VisaPoint will not be responsible for items misplaced, damaged, delayed or destroyed by a consulate, embassy or passport office. Passport covers and other documents not relating to the application should be retained by the client. VisaPoint accepts no responsibility for the loss or damage of such documents.

The fee payable by the client for services provided by VisaPoint does not include any consular or embassy charges. Any such charges will be the liability of the client. VisaPoint reserves the right to raise its fees at any time.

Consular fees as well as the availability of services may change without notice. Fees and services may change after the order has been placed. VisaPoint will make every effort to communicate these changes to the client where possible. VisaPoint will select the most appropriate service available in accordance with the time constraints indicated by the client.

VisaPoint’s fee and any consular or embassy charges are payable on receipt of application, except in those cases where the customer already has an account with VisaPoint.

Where VisaPoint receives personal data, as defined by the Data Protection Act 1998, from the client it will ensure it fully complies with the provisions of the Act – VisaPoint will only use this data to fulfill its obligations under the contract. VisaPoint will indemnify the client for any breach of the Act which renders the latter liable for any costs, claims or expenses. VisaPoint will allow its staff reasonable access to the information in order to ensure that the application is processed effectively.

VisaPoint reserves the right to retain all passports and documents until payment of all amounts due is received in full.

VisaPoint reserves the right to refuse to process an application without the obligation of providing an explanation.

These terms and conditions shall be governed by English law.
